Building Compliance Consultancy

Many landlords and property managers are unaware of their responsibility with managing their property until something goes wrong. Our consultants can explain commercial landlords’ responsibilities and help to put a cost effective action plan in place.

Display Energy Certificates

All larger public buildings require an annual Display Energy Certificate (DEC) highlighting their energy performance. This is to be displayed prominently in a place visible to the public. These buildings also require a DEC Recommendation Report (DEC-RR) providing recommendations for energy improvements each seven years.

There are slight variances on the requirements depending on the size of the buildings, as detailed below.

Buildings Over 1000 m2

  • The DEC is valid for one year and must be renewed annually.
  • The Recommendation Report is valid for seven years.

Buildings Under 1000 m2

  • The DEC and Recommendation Report are both valid for a ten-year period.

To comply with the Energy Performance of Buildings Directive, valid Display Energy Certificates must be displayed in a prominent location, and the Recommendation Report be available to review upon request. Organisations failing to adhere could face a fine of £1,500.

A DEC show the energy performance of a building by using an A-G rating system and how the building is performing, compared to the previous two DECs issued. TEAM customers include; Schools, Historic Buildings, Museums, NHS Trusts, Universities, Emergency Services and Local Authorities.

Energy Performance Certificates

An Energy Performance Certificate (EPC) rates how energy efficient your building is using grades from A to G (with ‘A’ the most efficient grade).

When you need an EPC

You must have an EPC if:

  • you rent out or sell the premises
  • a building under construction is finished
  • there are changes to the number of parts used for separate occupation and these changes involve providing or extending fixed heating, air conditioning or mechanical ventilation systems

You can be fined between £500 and £5,000 based on the rateable value of the building if you don’t make an EPC available to any prospective buyer or tenant.

When you must display one

You must display an EPC by fixing it to your commercial building if all these apply:

  • the total useful floor area is over 500 square metres
  • the building is frequently visited by the public
  • an EPC has already been produced for the building’s sale, rental or construction

Energy Saving Opportunity Scheme

ESOS is a mandatory energy assessment scheme for organisations in the UK that meet the qualification criteria. The Environment Agency is the UK scheme administrator.

Organisations that qualify for ESOS must carry out ESOS assessments every 4 years. These assessments are audits of the energy used by their buildings, industrial processes and transport to identify cost-effective energy saving measures.

Organisations must notify the Environment Agency by a set deadline that they have complied with their ESOS obligations. The deadline for the first compliance period, 5 December 2015, has now passed.

Organisations that are required to participate  in the scheme will meet the qualification criteria if they are defined as a large undertaking. These are:

  • Any UK company that either employs 250 or more people, or has an annual turnover in excess of 50 million euro (£38,937,777), and an annual balance sheet total in excess of 43 million euro (£33,486,489)
  • An overseas company with a UK registered establishment which has 250 or more UK employees (paying income tax in the UK)

You must take part in ESOS if your undertaking is part of a corporate group which includes another UK undertaking or UK establishment which meets these criteria.

We are registered Lead Assessors for ESOS through the Chartered Institute Building Services Engineers and have assisted organisations such as Quinetiq and Credit Agricole meet their compliance requirements.

MEES Regulations

As of 1 April 2018, part three of the Energy Efficiency (Private Rented Property) (England and Wales) Regulations 2015, more commonly known as the MEES regulations, came into effect. These relate to minimum energy efficiency standards and affect commercial property as well as residential property.

The rules are being implemented in two phases:

  1. From 1st April 2018, it will be against the law for a landlord to grant a new lease of commercial property with an EPC rating of F or G. This will also prevent subleases and lease renewals.
  2. From 1st April 2023, it will be against the law for a landlord to continue to let a commercial property with an F or G rating. This means that a lease that was legal when granted will become unlawful in April 2023
